Right of withdrawal for consumers
(A consumer is any natural person who enters into a legal transaction for purposes that are predominantly outside their trade, business or profession.)

Withdrawal policy

The statutory right of withdrawal of 14 days applies.

Right of withdrawal
You have the right to withdraw from this contract within 14 days without giving any reason.

The withdrawal period is 14 days from the day
- on which you or a third party named by you, who is not the carrier, took possession of the goods, provided that you ordered one or more goods as part of a single order and these are delivered together;
- on which you or a third party named by you, who is not the carrier, took possession of the last item, provided that you ordered several goods as part of a single order and these are delivered separately;
- on which you or a third party named by you, who is not the carrier, took possession of the last part-shipment or the last item, provided that you ordered goods that are delivered in several part-shipments or items;
- on which you or a third party named by you, who is not the carrier, took possession of the first item, provided that goods are delivered regularly over a defined period as part of one order.

To exercise your right of withdrawal, you must inform us (urbanhive Farming Solutions UG (haftungsbeschränkt), Wallgraben 5, 48356 Nordwalde, Germany, email address: happy@urbanhive.de) of your decision to withdraw from this contract by means of a clear statement (e.g. a letter sent by post or an email). You may use the attached model withdrawal form for this, although it is not mandatory.

Online withdrawal via your customer account: You can also declare your withdrawal or return directly online. To do so, log in to your customer account at account.urbanhive.de (log in simply with an email confirmation code, no password required) and select “Request return” for the relevant order — either for the entire order or for individual items. We will confirm receipt of your declaration by email without delay.

Alternatively, cancellation or the return of the order can be requested in the customer area.

To meet the withdrawal deadline, it is sufficient for you to send your notification concerning your exercise of the right of withdrawal before the withdrawal period has expired.

Consequences of withdrawal
If you withdraw from this contract, we shall reimburse to you all payments received from you, including the original delivery costs but not the costs of return shipping, without undue delay and in any event not later than 14 days from the day on which we are informed about your decision to withdraw from this contract. For this reimbursement we will use the same means of payment that you used for the original transaction, unless expressly agreed otherwise with you; in no event will you be charged any fees as a result of this reimbursement. 

We may withhold reimbursement until we have received the goods back or until you have supplied evidence of having sent back the goods, whichever is the earlier.

You shall send back the goods or hand them over to us or to Wallgraben 5, 48356 Nordwalde, Germany, without undue delay and in any event not later than 14 days from the day on which you communicate your withdrawal from this contract to us. The deadline is met if you send back the goods before the period of 14 days has expired.

You shall bear the direct cost of returning goods that can be sent by post as well as the direct cost of returning goods that cannot be sent by post. The cost for goods that cannot be sent by post is estimated at a maximum of approximately EUR 6.50.

You are only liable for any diminished value of the goods resulting from handling other than what is necessary to establish the nature, characteristics and functioning of the goods.

Grounds for exclusion or expiry

The right of withdrawal does not apply to contracts

- for the supply of goods that are not prefabricated and for the manufacture of which an individual selection or decision by the consumer is decisive, or which are clearly tailored to the personal requirements of the consumer;
- for the supply of goods that are liable to deteriorate rapidly or whose expiry date would quickly be exceeded;
- for the supply of alcoholic beverages whose price was agreed at the time of conclusion of the contract, but which can be delivered at the earliest 30 days after conclusion of the contract and whose current value depends on market fluctuations beyond the trader's control;
- for the supply of newspapers, periodicals or magazines, with the exception of subscription contracts.

The right of withdrawal expires prematurely in the case of contracts

- for the supply of sealed goods that are not suitable for return for reasons of health protection or hygiene, if their seal was removed after delivery;
- for the supply of goods that, after delivery and due to their nature, have been inseparably mixed with other items;
- for the supply of sound or video recordings or computer software in sealed packaging, if the seal was removed after delivery.

- If previously used, the product must be in technically perfect condition and must not show any significant visual defects.
- The product must be returned in its original box.

You have the right to withdraw from this contract within 30 days without giving any reason. The voluntary right of withdrawal begins after the statutory right of withdrawal (of 14 days) has expired and runs for a further 16 days. This gives you a total of 30 days' right of withdrawal (14 days statutory, 16 days voluntary).

Voluntary right of withdrawal / money-back guarantee

As an urbanhive customer, you have the right to withdraw from your purchase within 30 days without giving any reason. This voluntary right of withdrawal begins after the statutory right of withdrawal (14 days) has expired and extends it by a further 16 days, giving you a total of 30 days' right of withdrawal.

To exercise your right of withdrawal, please send us a clear statement, such as a letter or an email. You may use our model withdrawal form for this, but it is not mandatory. What matters is that you send the notification before the deadline expires.

Once you withdraw from the contract, we will refund the payment for the smart indoor garden within 14 days after the product has demonstrably been returned. For the refund we will use the same means of payment that you used for the original transaction, unless expressly agreed otherwise. We reserve the right to withhold the refund until the goods have reached us or until you have supplied evidence of having sent back the goods. In addition, the goods must be in perfect condition.

Your statutory right of withdrawal and your statutory warranty rights remain unaffected by this and continue to apply independently of this voluntary right of withdrawal.
